Section 1.0 Distribution
Article Marketer is an article submission and promotion service distributing royalty free content on a non-exclusive basis for reprint by webmasters, publishers, and editors. If you are an author that charges a fee for publication of your articles or requires that special terms be met prior to publication of your work, you should not submit your material to this site.
Section 1.1 Endorsement
Article Marketer does not endorse any statements or claims made in any
article submitted and does not accept any responsibility or liability for the
use of any information distributed through this service. Submission of articles
in violation of editorial guidelines could result in the closing of your
Article Marketer account, forfeiture of payment and other actions under
applicable law. By submitting material for review, you accept this agreement in total. By accepting this agreement, you agree to submit articles within the established guidelines. The Article Marketer review team will provide specific information about each article that requires attention. You agree to bring your articles into compliance with Article Marketer reviewer comments.
Article Marketer reserves the right to refuse to distribute
any materials at any time for any reason.
Section 1.2 Language
Your article must not contain foul language, profanity, offensive material, or
any language which could be construed as slander, hate or racism. You must not
submit any articles containing any language other than English. You must not
link to any sites that promote hacking, nefarious, illicit, or illegal activity. You
must not link to sites containing malicious download files or warez.
Section 1.3 Content
Submitting advertising is strictly prohibited. Thinly veiled advertising purported to be an article is frowned upon, is not likely to get published, and will not be accepted through our service. Acceptance of material by Article Marketer for distribution does not guarantee that it will be accepted by publishers, increase your web traffic, or otherwise provide benefits to you. Articles and other materials will be reviewed by individual editors or publishers before being published, not necessarily before being distributed. Criteria for distribution or publication may include: value of article to readers, fit with topics, general quality, unique content, correct spelling and grammar.
Section 2.0 Categorization
When Article Marketer submits your article, it will be offered to publishers and editors on the basis of article length and categorization. You must correctly categorize your submission in a way that accurately reflects the content of your article. Author agrees to accurately categorize articles prior to submission. Article Marketer reserves the right to re-categorize or reject incorrectly categorized articles.
Section 2.1 Guidelines - Length
In general, editors are looking for articles between 400 and 1200 words in length, containing valuable content for their readers. Some publishers have character count or line count guidelines for submission. Article Marketer attempts to follow all publisher guidelines when submitting your articles. It is unlikely that an article will be sent to every editor, publisher, or web site in the Article Marketer Community.
Section 2.2 Guidelines - Time
Some publishers and distribution sites have strict guidelines regarding the number of articles an author may distribute in a given time period. The Article Marketer software takes these guidelines into consideration and will distribute your articles accordingly. This may impact the distribution cycle of your articles.
Section 2.4 Guidelines - Publishing
Some publishers and distribution sites require that publishing guidelines are included with each article submitted. The Article Marketer system appends the following publisher guidelines according to publisher requirements:

Section 3.0 Email Verification
You agree to keep Article Marketer updated with your current email address. Failure to notify Article Marketer of changes to your correct email address may result in your existing articles being purged from the Article Marketer system, your account suspended, and payment forfeited. Once purged from the system, your articles cannot be retrieved. Article Marketer may verify your email address before your articles are distributed. If you fail to validate your email address, your article(s) will not be distributed.
Section 3.1 Contact
Article Marketer will contact you from time to time with submission reports indicating the results of our efforts as well as communications and announcements that pertain to Article Marketer or other products. Please make sure that editor [AT] Article Marketer and info [AT] Article Marketer are included in your email "whitelist".
Section 3.2 Membership Confirmation
You may receive email from the various publications, newsgroups, and article announcement lists to which your article is submitted. You may also receive automated replies from email distribution lists. Membership accounts will be created on your behalf using the credentials (author name, email address, username and password) you provided during the submission process. You agree to quickly respond to any membership confirmation requests sent to your email address to ensure that your article may be submitted. Failure to do so may result in disallowing your article submission to those sites. Once an article has been rejected, it may not be resubmitted to a site, regardless of the reason for rejection.
VERY IMPORTANT - DON'T SKIP THIS
Section 4.0 Email
Author understands that part of the group membership process is to confirm your desire to join these groups, with the setting of author preferences. Each group offers email distribution preferences and the default option is "Individual Email". This setting results in the author receiving copies of every article distributed by that group. Generally, only publishers and editors want copies of each article, and this can be frustrating and overwhelming for authors.
ARTICLE MARKETER STRONGLY RECOMMENDS THAT YOU CHANGE THE SETTING TO "NO EMAIL" DURING THE CONFIRMATION PROCESS.
Section 4.01 Email Usage
Author agrees that the email address used has been specifically set up for article marketing and that a significant amount of mail will be received by this address. Receiving a lot of email at this address is specifically disallowed as grounds for cancelling this agreement.
Section 4.1 Memberships
Due to privacy considerations, there is no third party notification (in this case, to Article Marketer) about your membership status with these sites, groups and lists. Our system assumes that you have joined these groups and will attempt to submit your articles as a member. If you are not a member, you will receive notices from the group moderator that you cannot submit articles until you become a member. To be allowed to submit you must join the group using the email address associated with your articlemarketer account. Once an article has been rejected by a group for any reason, it may not be re-distributed to that group, email list, or content site.
Section 4.2 Author Profile
An author's first and last name must be included with your submission. An author account may contain a single author profile, which cannot be changed once any articles have been distributed. If you distribute articles under multiple profiles or for multiple authors, you must create multiple Article Marketer author accounts. Articles by an author other than the named account holder may not be submitted and may be deleted without notice.
If you have co-written an article with someone else, decide which party will take the listing credit and submit the article using that name. While you are allowed to create and use an author profile, be aware that some publishers will not accept nor publish articles without a name appearing to be that of an actual person. Do not include professional or educational certifications (M.D. Ph.D, MFCC, etc.) in the author name fields. Do not use a company name or professional profile (XYZ Inc., Mr. Magician, Kitty the Clown etc.) as an author profile name.
Section 4.3 Article Marketer Subscriptions
Article Marketer offers primarily automatically recurring subscription accounts. As an account holder, you acknowledge and warrant that you have used the "my subscriptions" section of your PayPal account to verify the specifics of your personal Article Marketer subscription account. You further warrant that you understand the nature of your membership account and whether it is automatically recurring or a one-time payment. It is the account holder's sole responsibility to ensure the account type (recurring/one-time) meets account holder's expectations. Please verify your understanding by cross-referencing the check-out screen with the email confirmation from PayPal and with the information displayed in the "my subscriptions" area of your PayPal Account.
The recurring nature of an Article Marketer subscription is confirmed during the check-out process and also in the confirmation note sent in response to your account payment. Recurring accounts automatically renew on the anniversary date. Author agrees to make funds available for withdrawal upon the anniversary date. Failure to make the necessary funds available may result in civil or criminal prosecution.
Author understands that PayPal, as a trusted third-party, manages all subscription payment processing. Cancelling your subscription
immediately stops any future scheduled payments. Refer to Section 4.3.1 for recurring subscription payment refund eligibility. One-time memberships may be neither cancelled nor refunded once one or more articles have been submitted for review.
Recurring subscriptions automatically renew on the billing date until canceled through your PayPal account. If you would like to cancel your Article Marketer
subscription, login to your PayPal account. You will find complete instructions in the
PayPal help system. Type "How do I cancel my subscription?" into the PayPal help system search
box. You may cancel your subscription through your PayPal account at any time without refund.
The Article Marketer account shall be available for author to submit unlimited articles in accordance with the associated guidelines and this agreement during each billing cycle. Author agrees not to dispute this agreement if the account is available for use during more than 70% of the billing period.
Section 4.3.1 Refunds
An Author making the personal choice to abandon or otherwise not use his or her available Article Marketer account shall be deemed a voluntary non-user and shall forfeit all rights to his or her account during the remining subscription term without refund.
Refunds are available only on subscription payments erroneously collected by PayPal for subscriptions properly cancelled - and confirmed - through PayPal prior to the renewal date. Refunds are not available for subscriptions cancelled on or after the renewal date. No refunds will be made for any subscription payments deducted by PayPal for subscriptions which are active (according to PayPal, which shall be deemed an independent third-party) as of
the renewal date.
PayPal puts a timestamp on all cancellations. In the event of query or challenge, PayPal's timestamp shall be deemed the time of record. There will be no refunds of subscription payments for cancellations processed after the renewal subscription payment is initiated.
In no event will refunds be given if articles have been submitted for review (regardless of the outcome of the review) during the subscription billing period.
No payments will be refunded after 30 days.
4.3.1.1 Refund Administrative Fees
With the exception of credit card fraud or PayPal error, Author agrees to the following administrative fees:
In no case shall author initiate a credit card chargeback once articles have been submitted for review. Submission of article(s) for review constitutes notification and acceptance of these fees.
Section 4.3.2 Abandoned Lifetime Accounts
Lifetime accounts are considered abandoned when there have been no new articles submitted over a period of 12 consecutive months. Abandoned Lifetime accounts are deactivated and purged from the system. Once an account is deactivated, you will no longer have access to the account, articles, or comments about your account. Purged accounts cannot be reactivated.
Section 5.0 Copywritten Material
Article Marketer policy prohibits the use of copyrighted material in a manner that violates the copyright owner's rights. In general, this means that you should only submit your own original written work to which you have natural copyright. As an author, you retain all copyrights to your material.
Section 5.1 Rebranded Material
Article Marketer will accept one copy of any article text. The first author submitting an approved version of the article will have preference. Subsequent submissions of essentially the same article will be disallowed. If you have purchased the rebranding or reselling rights to an article, you must modify the article enough to make it unique. Duplicate articles may be deleted without notice.
Section 5.2 Distribution
Material submitted through Article Marketer is the sole responsibility of the author and does not represent the opinion of Article Marketer management, employees, or partners. All subscriptions are for the term shown and are automatically renewed at the end of the term unless cancelled prior to the billing date. Once an article has been submitted to the Article Marketer site there are no refunds. You agree to allow Article Marketer to distribute your material on a non-exclusive, royalty-free basis, while you retain full rights to your written work. You agree to allow publishers to freely disperse your material at no cost. Distribution of your material is done for exposure and publicity purposes only.
Section 5.3 Indemnification
Author shall defend, indemnify, save and hold Article Marketer harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Article Marketer, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by author, author's agents, employees or assigns. Article Marketer will not be responsible for any damages your business may suffer. Article Marketer makes no warranties of any kind, expressed or implied, for services provided. Article Marketer disclaims any warranty or merchantability of fitness for a particular purpose. This includes any loss resulting from delays, no delivery, wrong delivery, and any and all service interruptions caused by Article Marketer and its employees.
Section 5.4 Severability
If any term or provision of this Agreement or the application thereof to any circumstance will, in any jurisdiction and to any extent, be invalid or unenforceable, such term or provision will be ineffective as to such jurisdiction to the extent of such invalidity or unenforceability without invalidating or rendering unenforceable the remaining terms and provisions of this Agreement or the application of such terms and provisions or circumstances other than those as to which it is held invalid or unenforceable, and a suitable and equitable term or provision will be substituted therefore to carry out, insofar as may be valid and enforceable, the intent and purpose of the invalid or unenforceable term and provision.
Section 6.0 Revision
Article Marketer reserves the right to revise its policies at any time without notice. Failure to comply with this agreement may result in suspension or cancellation of your account and forfeiture of payment.
